Terms of Use & Privacy Notice

These terms explain the rules for using DS Card Co. and how personal information is handled.

DS Card Co. is a free, fan-made collection-organising service. By creating an account or continuing to use the service, you agree to these Terms of Use. The Privacy Notice applies whenever we process your personal information.

Terms of Use

1. Who operates the service

DS Card Co. (“DS Card Co.”, “we”, “us” or “our”) operates this website and is the controller of personal information described in the Privacy Notice. Questions can be sent to support@dscardco.co.uk.

2. Eligibility and accounts

You must provide accurate account information and keep your login details secure. You are responsible for activity performed through your account and should contact us promptly if you suspect unauthorised access.

The service is not directed at children under 13. If you are under 18, you should use it only with the involvement and permission of a parent or guardian. We may suspend access where reasonably necessary to protect a user, the service or other people.

3. Permitted use

You may use DS Card Co. for lawful personal collection organisation. You must not:

  • break the law, infringe another person's rights or upload material you do not have permission to provide;
  • attempt unauthorised access, probe security, bypass access controls or interfere with the service;
  • introduce malware, scripts, harmful code or content intended to disrupt another user;
  • use automated means to extract, harvest or reproduce substantial parts of the catalogue or service without written permission;
  • misrepresent identity, ownership, affiliation, card information or trade availability;
  • use public lists, links or other features to harass, deceive, spam or facilitate unlawful activity.
4. Your collection data and submissions

You retain ownership of original information, text and images you submit. You give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that material only as needed to operate, secure and improve the service and to provide public sharing features you deliberately enable. This licence ends when the material is deleted, except for limited backup retention or where the law requires continued storage.

You confirm that you have the necessary rights and permissions for anything you send or upload. We may review, reject or remove material that is unlawful, unsafe, infringing, misleading or incompatible with the service.

5. Catalogue and market information

Catalogue information is supplied for personal collection organisation. The Pokémon TCG contains complex regional, promotional and historical releases, so records may be incomplete, delayed or corrected as evidence improves. You should verify important details independently.

Prices are third-party market-reference data, may be converted between currencies and are not live offers, appraisals, guarantees or financial advice. Condition, language, timing, seller and location can materially affect a card's actual value. You remain responsible for buying, selling and trading decisions.

6. Public links and third-party services

If you choose to make a list public, anyone with access to it may view and further share the information displayed there. Review a list before publishing it and avoid including personal or sensitive information.

The site may link to services such as Cardmarket, eBay or catalogue providers. Those services are independent and apply their own terms and privacy notices. A link does not mean that we control, endorse or guarantee the third party, its content, listings or availability.

7. Availability and changes

We aim to keep DS Card Co. useful and available, but do not promise uninterrupted, error-free or permanent operation. We may maintain, update, restrict, suspend or discontinue features and may correct or remove catalogue content. Where practical, material changes affecting users will be communicated through the site.

8. Suspension and termination

You may stop using the service and delete your account through your Profile. We may restrict or terminate access where these terms are materially or repeatedly breached, where security or legal obligations require it, or where continued access creates a genuine risk to the service or others. Where appropriate, we will provide notice and an opportunity to address the issue.

9. Responsibility and liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or rights that cannot be excluded under applicable consumer law.

Subject to those protections, DS Card Co. is provided for personal use on an “as available” basis. We are not responsible for losses that were not reasonably foreseeable, arise from reliance on catalogue or price information without independent verification, result from a third-party service, or are caused by events reasonably outside our control. Users should retain exports or other backups of collection information that is particularly important to them.

10. Governing law

These terms are governed by the laws of England and Wales. If you are a consumer elsewhere, you retain any mandatory protections and rights to bring proceedings that apply in your home jurisdiction. We encourage you to contact us first so we can try to resolve a concern informally.

Copyright, brands and ownership

DS Card Co. original material

Except for third-party material described below, the original DS Card Co. branding, logo artwork, website design, written content, original graphics, software code, and original selection and arrangement of site content are owned by DS Card Co. or used under licence and are protected by applicable copyright and other intellectual-property laws.

You may not copy, reproduce, republish, distribute, sell, license, commercially exploit, create an unauthorised derivative of, or systematically extract substantial parts of DS Card Co.'s protected material without prior written permission, except where applicable law expressly permits it. The DS Card Co. name, logo and visual identity may not be used in a way that suggests affiliation, endorsement or an official connection.

Third-party Pokémon material

DS Card Co. is an unofficial fan project and is not affiliated with or endorsed by The Pokémon Company, Nintendo, Game Freak or Wizards of the Coast. Pokémon names, card artwork, characters, symbols and related trademarks and copyright remain the property of their respective owners. Their appearance is for identification and collection-organisation purposes and does not transfer ownership to DS Card Co.

Infringement concerns

To request permission, report unauthorised use of DS Card Co. material or raise a concern about third-party rights, email support@dscardco.co.uk with enough information to identify the work and the issue.

Privacy Notice

1. Information we collect
  • Account information: email address, username, password hash, verification and account status.
  • Collection information: cards, quantities, variants, conditions, languages, grades, notes, lists, goals and preferences you save.
  • Public content: lists or collection information you deliberately choose to publish or share.
  • Support information: messages, correction evidence, attachments and correspondence you send us.
  • Security and technical information: sign-in and security events, request information, device or browser details, IP address and diagnostic logs where generated by our systems or hosting infrastructure.

You must provide an email address, username and authentication information to create an account. Other collection and profile details are optional, although a feature may not work without the information it needs.

We do not use collection information for solely automated decisions that produce legal or similarly significant effects.

3. When information is shared

We do not sell personal information. We may share only what is necessary with:

  • hosting, database, email, security and technical service providers acting on our instructions;
  • people who view information you deliberately make public;
  • professional advisers, insurers or authorities where reasonably necessary to comply with law, protect rights, investigate abuse or establish legal claims;
  • a successor operator if the service or its relevant assets are reorganised or transferred, subject to appropriate confidentiality and notice where required.

Third-party catalogue and market services normally provide information to us; we do not send them your private collection merely because their data appears in the catalogue.

4. International processing

Some technical providers may process information outside the United Kingdom. Where a restricted transfer occurs, we require an applicable lawful transfer mechanism, such as UK adequacy regulations or approved contractual safeguards, together with proportionate security measures. Contact us if you need more information about safeguards relevant to your data.

5. Retention and deletion

Account and collection information is generally retained while your account remains active. When you delete your account, active account and collection records are scheduled for deletion. Operational backups are retained for a limited rolling period—normally no more than 14 days—before automatic expiry. Support, security or legal records may be retained longer where reasonably necessary to resolve a request, prevent abuse, comply with law or establish legal claims.

When a precise period is not stated, we assess retention using the purpose of the record, its sensitivity, security needs, applicable limitation periods and legal obligations. Data may be irreversibly anonymised instead of deleted where it can no longer identify you.

6. Security

Passwords are stored as hashes rather than plaintext. We use proportionate technical and organisational controls intended to protect personal information, including access controls, authentication measures, security logging and backups. No internet service can guarantee absolute security, so keep your password unique and contact us promptly if you believe your account is at risk. Never send us a password or verification code.

7. Cookies and browser storage

DS Card Co. uses browser storage and similar strictly necessary technology for sign-in, session continuity, security and preferences. The current service does not require advertising or behavioural-tracking cookies. If optional analytics, advertising or other non-essential technologies are introduced, this notice and any required consent controls will be updated before they are used.

8. Children's privacy

The service is not directed at children under 13, and we do not knowingly seek their personal information. Because Pokémon collecting can interest younger people, we aim to minimise collection, use privacy-protective defaults and avoid behavioural advertising. A parent or guardian who believes a child has provided personal information should contact us so we can investigate and take appropriate action.

Your privacy rights

Depending on the circumstances and lawful basis, UK data-protection law may give you rights to:

  • request access to your personal information and a copy of it;
  • correct inaccurate or incomplete information;
  • request deletion or restriction of processing;
  • object to processing based on legitimate interests;
  • receive information you provided in a portable format;
  • withdraw consent at any time where processing relies on consent, without affecting earlier lawful processing;
  • complain to the Information Commissioner's Office.

You can export or delete account and collection information from your Profile. For another request, email support@dscardco.co.uk. We may need to verify your identity and may ask for information needed to locate the relevant records. Rights can be subject to legal exemptions.

Your right to object: where we process information for legitimate interests, you may object by contacting us and explaining your circumstances. We will stop unless we have compelling legitimate grounds or need the information for legal claims.

If you remain unhappy, you may complain to the Information Commissioner's Office. We would appreciate the chance to address the concern first.

Changes to these terms and notice

We may update this page when the service, law or our data practices change. The date above shows the latest version. If a change materially affects registered users or how personal information is used, we will provide proportionate notice through the service or by email where appropriate. Continued use after updated Terms of Use take effect constitutes acceptance, but a privacy notice change does not create consent where the law requires a separate choice.
